Gregg v. Georgia, 428 U.S. 153 (1976)

In Gregg v. Georgia, 428 U.S. 153 (1976) the United States Supreme Court reaffirmed the court's acceptance of the death penalty.  The defendant argued for the court to take the next step and declare capital punishment unconstitutional.  However, the court held that the death penalty "comports with the basic concept of human dignity" required by Eighth Amendment.  Therefore the court reaffirmed the constitutionality of the death penalty.
